The Knauf Entities have hired Moss & Associates to "remediate" homes according to the terms set forth in the Settlement Agreement for the Demonstration Remediation of Homes with KPT Drywall ("Demonstration Remediation Agreement"). You may download a copy of the Demonstration Remediation Agreement. Below is a broad overview of the remediation process.

Inspection of Home

Within 2 weeks of the Knauf Entities providing an address to Moss, Moss will contact the homeowner or their counsel to schedule an inspection of the home. Such an inspection will take place, generally, within 2 weeks of Moss making contact. This inspection is designed to determine the exact work that Moss will need to do to the home. During this inspection, which the homeowner and/or his/her counsel have a right to attend, Moss will note every detail of the home, right down to the number of coats of paint on the walls.

Creating the Scope of Work for the Home

After Moss' inspection is complete, Moss begins the process of establishing a budget for the remediation of the home, including collecting bids from subcontractors. Work Authorization Agreement and Release

Once the scope of work and budget are finalized, Moss will send homeowner's counsel a "Work Authorization Agreement." This is a contract between the homeowner and Moss (as the Knauf Entities' agent) that includes the specific scope of work for the home, lays out the terms and conditions under which Moss will perform the work, and provides an estimate for how long the remediation will take (typically, 90 days). Homeowners must also sign a release before remediation work can commence.

Starting the Work in the Home

After Moss receives signed copies of the Work Authorization Agreement and release from the homeowner, Moss will submit a funding request to the Knauf Entities for the remediation work to be done in the home, which typically takes about 2 weeks. During this time, Moss will work to obtain the necessary permits for the remediation, and also to finalize, with the homeowner, selections for finishes, appliances, etc. Once the Knauf Entities fund the remediation of the home, the homeowner has made all of his/her selections, and Moss has received the necessary permits, Moss will send the homeowner a "Move-Out Notice," requesting that the homeowner move out of their home within 20 business days so that remediation can begin. For the reasons further discussed below, it is important that homeowners not move out of their home before receiving the Move-Out Notice. Vacant homes do not require the minimum notice and may be started sooner.

The move-out notice will include a "move-out date," which is Moss contractual start date. On the move-out date, Moss holds a "kickoff" meeting at the to-be-remediated home with the homeowner and subcontractors that will be performing work in the home in order to discuss the upcoming remediation.

Within 5 business days of receiving the Move-Out Notice, the Knauf Entities will make a lump sum payment to the homeowner in order to help pay for their alternative living expenses during the remediation. This amount varies depending on the size of the home . It is very important that the homeowner not move out of their home prior to receiving the Move-Out notice because this payment is only meant to fund alternative living expenses during the remediation period. The Knauf Entities will not reimburse additional living expenses the homeowner incurs by vacating their home before receiving a Move-Out Notice.
